Transferring wages to an employee’s card is also convenient because banks usually create for payroll clients special terms of service:

  • they do not charge for issuing or replacing cards;
  • offer credit cards and loans at reduced interest rates;
  • add bonuses when opening a deposit, etc.

According to Article 136 of the Labor Code, the employee himself can choose the method and place of receiving wages. As a rule, the employer already has a service agreement with the bank (the so-called “salary agreement”), and seeks to transfer the salaries of all its employees to the cards of this institution.

Is it possible to transfer salary to another person’s card?

The law does not limit an employee’s right to transfer part of their salary or the entire amount to another person’s card. This could be a relative (wife, brother, parents, children) or a complete stranger. This right is enshrined in Article 136 of the Labor Code of the Russian Federation and in the international Convention “On the Protection of Wages” ratified by Russia.

In this case, the employee can fill out an application and attach a writ of execution (or, for example, a copy of the loan agreement). Otherwise, the bailiffs will do it for him.

How to write an application for salary transfer to a card

Nowadays, wage payments to a bank card are specified in the employment contract itself. The data is also specified in the legislation. But the law enshrines the employee’s right to independently choose how the employer will pay him, explaining this in his application.

He can indicate the company’s bank, or he can choose his own bank, or even declare that it is more convenient for him to receive cash rewards at the company’s cash desk. Therefore, writing an application to transfer wages to a card is a mandatory essential condition. The application must be saved and attached to the employee’s employment contract.

The application contains the mandatory conditions of the date from which the transfer will be made, as well as by which bank. The purpose of the payment is indicated, called the usual standard phrase - receipt of wages. As with all applications, the date is indicated and a signature is placed.

After this, the application must be endorsed by the manager and transferred to the personnel department and stored in the employee’s general documents. The agreement and the employer's visa are a prerequisite for accepting the form.

The following documents must be attached along with the application:

  • Personal account statement;
  • Passbook cover;
  • Card details.

Usually, when an employee is hired, he is issued a service bank card, but this is not a mandatory action. An employee can indicate the personal account of his current bank card or the card of his relative, and then the salary will be transferred to it until it expires or the employee independently changes the card information. But if the employee did not indicate his payment details, but the data of another person, he needs to write another statement indicating the reasons.

When a business entity hires hired personnel to perform work, it assumes the obligation to pay wages on time. At the same time, the employees themselves have the right to choose how exactly they want to receive their earnings - in cash from the cash register, or by transfer to a card. In the latter case, the employee must provide the accounting department with an application to transfer wages to the card.

To inform the accounting department that an employee wants to receive his salary on a bank card, he needs to draw up an application. Moreover, this document must be provided even if the employment contract already states that the payment is made to the card.

The law determines that an employee has the right to independently choose how exactly he wants to receive his earnings. If the method is not expressly indicated, then the salary must be paid in cash from the cash register at the place of performance of one’s duties.

In addition, the law establishes that the employee independently decides which bank card he wants to receive payments to. He can change the transfer details at any time. However, you need to follow the rule - the accounting department must be notified no less than 5 days before the salary payment date.

Therefore, the law establishes a greater significance for applications for salary transfers. Because it is to them that the employee expresses his desire to earn money. An employer cannot ignore the will of its employee.

Is it possible to receive a salary both on a card and through a cash register?

The employee is given the opportunity to choose exactly how he wants to receive his salary - in cash from the cash register, or by non-cash transfer to a card. This does not mean that he must choose one or the other - the employee may wish to receive both at the same time.

This means that, for example, he can receive an advance on wages by transfer to the card, but the rest of the salary in cash. Or vice versa.

Thus, the employee submits an application indicating the procedure for applying both methods. For example, he indicates in the document that the employee wants to receive an advance in the amount of 4,500 rubles in cash. The remaining amount must be transferred to the card using certain bank details.

Attention! The employee can indicate in percentage terms what share of his salary he wants to receive in cash, and what share must be transferred to the bank card.

Can an employee refuse to pay salary to the card?

The administration of a business entity has the right only to recommend to the employee a way to earn income. The employee must make the final decision himself. In particular, the employee is given the right to independently choose the banking organization in which to provide services.

Very often, banks where the company already has current accounts offer favorable conditions for salary card projects. In this situation, employees are issued cards on which they receive their earnings.

Using a card opened as part of such a project is most often beneficial to both the employee and the company. The employee gets the opportunity to open a loan on favorable terms with a reduced rate. For the company, funds are credited to such cards with a reduced commission.

However, before agreeing to open a salary project, the company needs to interview all its employees and take applications from them to open plastic card accounts. Next, it is necessary to make changes to the collective agreement and labor contracts with employees.

If an employee refuses to open a card account, the company has no right to force him to do so. Therefore, such an employee must be asked in writing how to receive his salary. If there is no response from him, then the money will need to be given to him in cash from the organization’s cash desk.

Can an employee receive a salary on his open card?

Employees can come to work already having current accounts opened in banks. Therefore, he can use his own card to receive a salary or ask to open it for a salary project in a given business entity.

This decision must be made by the employee independently. Pressure from the employer is not allowed; the employee does not need to obtain the consent of the enterprise administration.

To make his choice, the employee should submit an application to the company management, in which he must provide full bank details. After receiving this application from the employee, the administration will have to send the salary to the bank indicated by the employee.

At the same time, the employee must remember that if the bank details are incomplete, the company management will have the right to refuse the transfer and give the salary in cash. In this case, the company must send a message to the employee about the need to clarify the details he specified.

Important! The legislation establishes the obligation of the employer to bear all costs associated with the transfer of wages to the employee in the form of bank commissions.

There is no required form for this type of application. The employee can write it by hand, or type it on a computer and print it out. In the latter case, the form must have a live signature.

Drawing up an application begins from the top of the sheet - on the right. There it is necessary to write down for whom the document is being drawn up - in the dative case the name of the manager’s position, the name of the company, his full name are indicated.

The text of the application, as a rule, begins with a phrase expressing a request to transfer the salary using the details indicated below. It is not strictly mandatory, but it is advisable to indicate a link to the article regulating this action of the Labor Code of the Russian Federation - Art. 136.

After this, you need to put a colon and write the bank details for the transfer:

  • Checking account;
  • Correspondent account;
  • Bank's name;
  • TIN and checkpoint;
  • Card number;
  • FULL NAME. card holder.

The employee may have printed details on hand. He can receive them from the bank, or print them out himself from his personal account.

In this case, they can not be copied onto the application, but simply indicated in the application “according to the attached details.” However, in such a situation, you need to indicate below that the application is accompanied by an attachment - bank details.

The employee signs the application, after which it is submitted to the manager for approval.

Is it possible to transfer other payments to a salary card?

An employee’s salary card, opened to him within the framework of a salary project existing with the bank, is a regular card to which the employee has the right to send other payments other than his salary at the enterprise.

The main difference between such cards is the reduced cost of maintenance costs, as a result of which they may have some limitations in functionality. For example, to use Internet banking, you will need to additionally submit an application to the bank to connect to this service, as well as pay a special commission.

The employee retains the right to use his bank card at his own discretion. He can use it to pay for various purchases and services, replenish it using cash and transfers. It is beneficial for the bank that the employee uses the card in full, so they do not impose any prohibitions on transferring other funds.

Important! If the employee does not like something, he is given the right to independently determine the bank from which he will receive a card or money in cash.

Where do you get your salary?

As a general rule, wages are paid to the employee at the place where he performs the work by issuing it from the cash register (Part 3 of Article 136 of the Labor Code of the Russian Federation). But the Labor Code also provides for the possibility of transferring an employee’s salary to his bank account. A provision for this must be provided for in the collective or employment agreement with the employee.

It may indicate, for example, that the first half of the salary (advance) is issued from the cash desk, and the final payment is transferred to the bank. Or, for example, 20% of each payment is issued from the cash register, and the remaining amount is transferred to the employee’s card.

When we talk about transferring an employee’s salary to a bank, we are usually talking about so-called salary projects, which are concluded by employers and their credit organizations as part of banking services. In this case, the entire amount of wages is usually subject to transfer without dividing into cash and non-cash parts.

Reason for transfer to the card

Mere mention in the agreement of transferring salaries to the card is not enough. The employee must also write a statement in which he asks the Employer to transfer remuneration for his work to the card.

In this case, the employee can change the bank where the salary must be transferred by informing the employer about the change in details no later than 5 working days before the salary payment day.

Who pays for the transfer to the card

Regardless of whether wages are transferred as part of a mass salary project or individually at the request of an employee to his “special” bank, the employer pays the transfer commission at his own expense. At the same time, he can take these expenses into account when taxing profits as part of other (clause 25, clause 1, article 264 of the Tax Code of the Russian Federation) or non-operating (clause 15, clause 1, article 265 of the Tax Code of the Russian Federation) expenses in accordance with his own.

The employer can also transfer accountable amounts (including travel expenses) to the employee’s card, including salary. To do this, the employer needs to provide for such a possibility in a local regulatory act (for example, in the Regulations on settlements with accountable persons) and receive an application from the employee requesting to transfer accountable funds to his card (Letter of the Ministry of Finance dated August 25, 2014 No. 03-11-11/42288 ).

An employer needs a sample application for transfer of salary to a card to fulfill the requirements Art. 136 Labor Code of the Russian Federation regarding the procedure for paying staff salaries. It states that the salary can be issued to the employee at the enterprise’s cash desk or transferred to the bank account specified in the application. At the same time, the contract or collective agreement must contain information that the money will be transferred by the employer by bank transfer.

The application must be drawn up regardless of how the salary will be transferred to the employee’s card - to an account opened within the salary project, or to his personal account, opened by him without the participation of the employer.

If the employee does not provide the boss with a sample application for transfer of salary to the card, he will have to receive the money earned at the cash desk. The employer simply does not have the right to force an employee to receive funds by bank transfer.

Is it possible to choose a bank?

As a rule, employers themselves choose the bank in which accounts will be opened for workers to transfer salaries.

But, according to Art. 136 Labor Code of the Russian Federation, each employee who receives payment for work on a card can change the bank in which he is serviced. An application to change data for the transfer of funds must be submitted to the director no later than five working days before the day of payment of wages.

The positive aspects of this method of receiving a salary are obvious:

  • no need to stand in a long line to get money from the cash register;
  • It is convenient to store a bank card in a wallet;
  • banks often provide preferential lending conditions for salary clients.

There are practically no disadvantages. The only thing is that sometimes older workers cannot independently figure out all the nuances of withdrawing money from ATMs. Therefore, it is worth compiling a training manual for them.

How to apply for a salary transfer to a bank card

The application can be drawn up when signing an employment contract or a little later - as soon as the director or employee has a need for it. Let's look at how to properly prepare such a document. A sample application for transfer of salary to a card is drawn up in any form. It consists of a header and, in fact, text.

The header should include:

  • name of the employing organization, position and full name. manager;
  • position and full name compiler;
  • Below we indicate the name of the document: “Application for transfer of wages to a bank card.”
  • must contain a reference to labor legislation ( Art. 136 Labor Code of the Russian Federation) and the worker’s request to transfer the money he earned to a bank account indicating the details. This data is: account number, current account, name of the credit institution, BIC, INN, KPP, card number, full name. its owner (information can be obtained from a specialist at the bank);
  • Below is the date of the application and the employee’s handwritten signature.

Money will be transferred strictly according to the information provided by the employee. Payment of the commission for transferring funds always falls on the shoulders of the employer. If the accountant makes a mistake during the transfer and the money goes to the wrong account, he will be held responsible for it.
